1.1. Welcome to MetaBomb operated by affiliated companies ("We" or "MetaBomb").

MetaBomb takes its responsibility seriously regarding information security in compliance with the personal data protection laws of Vietnam and commits to respecting the privacy and concerns of all users regarding our Services.

Users mean individuals who register an account/provide information to us to use the Services we provide.

We recognize the importance of the personal data you have entrusted to us and believe that we have a responsibility to manage, protect, and handle your personal data appropriately. This privacy policy ("Privacy Policy" or "Policy") is designed to help you understand how we collect, use, disclose, and/or process the personal data you have provided to us and/or retained information about you, whether now or in the future, as well as to help you make informed decisions before providing us with any of your personal data.

1.2. "Personal data" or "Personal information" means data, whether true or not, about an individual through which the identity of that individual can be determined, or from that data and other information to which an organization has or is likely to have access. The data collected under section 3 of the Policy includes but is not limited to named information, age, date of birth, ID card or Citizen Identity Card (CCCD), phone number, address, email, payment information, and other data information you provide.

1.3. By using the Services, registering an account/providing your information to us, you acknowledge and agree that you accept the methods, requirements, and/or policies described in this Privacy Policy and/or the Terms of Use of our Services, and hereby confirm that you understand and agree to all permissions for us to collect, use, disclose, and/or process your personal data as described herein. If you do not agree to allow the processing of your personal data as described in this Policy, please do not use our Services. If we change our Privacy Policy, we will notify you through posting such changes or revised privacy policy on our website/application or other posting channels, and you may access it. Insofar as permitted by law, your continued access, use, or exploitation of the Services shall be deemed as your acknowledgment and agreement to the changes in this Privacy Policy.

1.4. This Policy applies together with notices, terms of service, contractual terms, other consent terms related to how we collect, store, use, disclose, and/or process your personal data and is not intended to override, replace, cancel those notices or terms unless we have another declaration.

  1. WHEN WILL METABOMB COLLECT PERSONAL DATA

2.1. We will/may collect personal data about you:

  1. when you register and/or use our Services, or open an account with us;
  2. when you submit any forms, including registration forms or other forms related to any of our products and services, online or otherwise;
  3. when you enter into any agreement or provide documents or information other interaction between you and us, or when you use our products and services;
  4. when you interact with us, such as through telephone calls (which may be recorded), letters, faxes, face-to-face meetings, social media platforms, and emails, or any other forms;
  5. when you use our services, or interact with us through our website/application or other channels. This includes through the deployment of cookie files we may implement when you interact with our Services;
  6. when you grant permissions on your device to share information with our Services/website/application or other channels;
  7. when you link your MetaBomb account to your social media account or other external accounts or use other social media features, subject to the policies of the provider;
  8. when you perform transactions through our Services, such as whenever you make payment or provide information sent to us for using the Services or requesting support;
  9. when you provide feedback or submit complaints to us;
  10. when you register to participate in a contest, program, event;
  11. when you submit your personal data to us for any reason; and/or
  1. when you engage in other activities on our website/application or other channels.

The above instances are not intended to exhaustively list all instances and only provide some common cases of when your personal data may be collected.

2.2. We may collect information about you from you, affiliated companies, third parties, and from other sources, including but not limited to business partners (e.g., payment service providers, solution providers, technical infrastructure, technology, communications), credit rating agencies, service provider partners, referral marketing, customer loyalty programs, other users using our Services, or publicly available data sources or government data sources, ...

2.3. In some cases, you may provide personal data of other individuals to us (such as family members, friends, or people in your contact list). If you provide us with their personal data, you declare and warrant that you have obtained their consent to process their personal data in accordance with this Policy.

3.1. Unless otherwise provided in this Policy, the personal data that MetaBomb may collect may include basic personal data and sensitive personal data, which may be all or part of the information listed below:

  1. full name;
  2. email address;
  3. date of birth;
  4. address;
  5. bank account and payment information;
  6. phone number;
  7. gender;
  8. ID card or CCCD;
  9. information submitted by or related to (the) device(s) used to access our Services;
  10. your account information, including your contact list when agreeing to share on your device, and the people and accounts you interact with;
  11. written text content, images or audio, or video;
  12. data information, resources initiated, performed, appearing during the use of our Services;
  13. personal identity information provided by the government or other information serving for legal assessment purposes, customer identification, information verification, and/or our fraud prevention;
  14. communication or contact data, such as options to receive advertising information from us or your third parties, communication means options, and communication history with us, our service providers, and other third parties;
  15. account usage information and transaction information, history, content, or other electronic formats you interact with when using the Services.

The above instances are not intended to exhaustively list all instances and only provide some common cases of your personal data that may be collected.

3.2. The information you provide to us may be true or untrue, we are not obligated to verify or intervene to edit your information (unless requested by you), you are responsible for the accuracy, honesty, and legality of the information you provide.

3.3. If you log in to become a user of the Service through using your social media account ("Social Media Account"), linking your account to your Social Media Account, or using any social media features, we have the right to access information about you that you have voluntarily provided to the service provider of your Social Media Account in accordance with the policies of these service providers, and we will manage, process, and use this personal data of yours according to the provisions of this Policy at all times.

3.4. If you do not want us to collect the above-mentioned information/personal data, you may choose not to participate at any time by notifying us in writing, which means you will cease to use the Services.

You also have the right to withdraw your consent, request deletion, restrict processing, object to processing, request personal data, access, or request a copy of your personal data at any time. However, please note that refusing, limiting, or revoking consent for us to collect, use, or process your personal data may affect your rights when using the Service.

  1. DATA COLLECTION OF OTHER INFORMATION

4.1. As with most websites and other mobile applications, your device sends information, which may include data about you, recorded by a server when you use our Service. This information typically includes but is not limited to IP address, computer/device operating system, browser type, mobile device type, mobile device characteristics, unique device identifier (UDID), or mobile device identifier (MEID) of your mobile device, referrer address of the website/mobile app (if any), pages you have accessed on our website/app, access time, and sometimes "cookies" (which can be disabled using your browser settings) to help the website/app remember your last visit. If you log in, this information is linked to your personal account. This information is also included in anonymous statistical data to help us understand how visitors use our website/app.

4.2. Applications may collect accurate information about your mobile device's location using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose, and/or process this information for one or more purposes including but not limited to providing services based on the location you request or delivering content relevant to you based on your location or allowing you to share your location with other users as part of the services provided by our mobile applications. For most mobile devices, you can withdraw permission for us to collect this location information through settings on the device. If you have any questions about disabling location services on your mobile device, please contact your mobile device service providers or device manufacturers.

4.3. As when you access/use our Service/website/mobile app, information may be sent to us (including but not limited to IP address, operating system, ...).

  1. COOKIES

5.1. Sometimes we or our service providers and advertising partners may use "cookies" or other features to allow us or third parties to collect or share information about your usage of our Service or website/mobile app. These features help us improve our website/mobile app and the services we provide, suggest new services and features, and/or allow us and our advertising partners to provide more relevant content to you. "Cookies" are unique identifiers stored on your computer or mobile device that store data about when and how the services or website/mobile app are used or accessed, by how many people, and to track activities on our website/mobile app. We may link cookie information to personal data. Cookies also associate with information about the content you have selected/used on the websites/mobile apps you have visited. This information is used to track your service usage activities, deliver content tailored to your preferences, allow partner service providers to deliver advertising services on pages across the internet, and to conduct data analysis and/or track service usage.

5.2. You can opt out of using cookies by selecting appropriate settings on your browser or device. However, please note that if you do this, you may not be able to use all the features of our website/mobile app or our services.

6.1. We may collect, use, disclose, and/or process your personal data for some or all of the following purposes:

  1. To review and/or process your service requests with us or payment transactions when you use our Service;
  2. To manage, operate, provide, and/or administer your use of the Service;
  3. To fulfill, process, resolve, or complete a transaction and/or respond to your requests for certain products and services and notify you of service issues and abnormal account activities;

  1. For identification, verification, legal assessment, or customer identification purposes;
  2. To maintain and manage any software updates and/or other updates and support that may be required from time to time to ensure the smooth operation of our Services;

  4. To contact you, for example via means such as phone, text message, fax, Zalo, email, and/or mail or other methods for administrative and/or relationship management purposes with us or your use of our Services;

To conduct research, analysis, and development activities (including but not limited to data analysis, surveys, developing and/or introducing product and service features), to analyze how you use our Services, to introduce products and/or services according to your interests, to improve our Services or products and/or to improve your customer experience;
  7. To enable other checks and surveys to, among other activities, verify the scale and composition of our target audience and understand their experience with MetaBomb's Services;
  8. For marketing and advertising purposes, in which case, to send you information and marketing and promotional materials related to products and/or services (including, but not limited to, products and/or services of third parties that MetaBomb may collaborate or partner with) that MetaBomb (and/or its affiliates or related companies) may sell, market, or advertise, whether the products or services;
  9. To provide regular customer loyalty programs and benefits, partner and promotional events, as well as MetaBomb's or affiliate marketing campaigns;
  10. To comply with legal procedures or to comply with or follow current legal regulations, and requests from competent state authorities or when we genuinely believe that disclosure of information is necessary, including but not limited to responding to disclosure requests for MetaBomb or cooperating affiliate companies;
  11. To compile statistical data and research to meet reporting requirements and/or maintain internal management or regulatory requirements;
  12. To conduct due diligence and verification processes or other screening activities (including but not limited to background checks) to comply with legal obligations or competent state authorities or our risk control procedures, may be legally required or may have been applied by us;
  13. To check our Services or MetaBomb's activities;
  14. To prevent or investigate any actual or suspected fraudulent activities related to our Terms of Service, fraud, illegal behavior, deficiencies, or any misconduct, whether related to your use of our Services or any issues arising from your relationship with us;
  15. To respond to any actual threats or requests asserted against MetaBomb or other related requests related to the content violations of third parties;
  16. To store, establish servers, backup (whether for disaster recovery purposes or other purposes) for your personal data;
  17. To process and/or facilitate a business asset transaction related to MetaBomb as a participant or only related to a company or affiliate of MetaBomb. "Business asset transaction" means purchase, sale, lease, merger, consolidation, or any acquisition, liquidation, or sponsorship of an organization or part of an organization or any business or asset of an organization;

6.2. Your agreement to provide personal information and use our Services means that you have confirmed, consented, and agreed that we may access, store, process, and disclose your Account and Content information if the law requires or by court order or any government agency or competent authority for MetaBomb or its relevant subsidiaries, MetaBomb's affiliate partners, or with legitimate reasons that MetaBomb believes that access, retention, or disclosure is necessary and reasonable to: (a) comply with legal procedures; (b) comply with requests from any government agency or competent authority for MetaBomb or relevant MetaBomb subsidiaries, affiliate partners of MetaBomb; (c) enforce our Terms of Service or this Privacy Policy; (d) respond to any complaints believed to be risks or actually occurring to fight against MetaBomb or related subsidiaries or other complaints that any Content violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property, or personal safety of MetaBomb or related subsidiaries, users, and/or the public.

  1. META BOMB'S PROTECTION AND STORAGE OF CUSTOMER INFORMATION

7.1. We implement various security measures and consistently strive to ensure the safety of your personal data on our systems. User personal data is stored behind security networks and can only be accessed by a limited number of employees with special access to our systems.

7.2. We will maintain personal data in compliance with privacy laws and/or other applicable laws. This means that we will erase or delete identifying information from your personal data when we receive a request from you in accordance with current legal provisions or when we have reasonable grounds to determine that (i) retaining that personal data no longer serves the purpose of collecting that personal data; (ii) retention is no longer necessary for any lawful or business purposes, and (iii) there are no other legitimate interests to continue retaining this personal data. If you cease to use our Services, or your right to use the service is terminated or canceled, we may continue to retain, use, and/or disclose your personal data in accordance with this Privacy Policy and our obligations under the privacy laws. Depending on legal requirements, we may securely delete your personal data without prior notice to you.

7.3. We reserve the right to refuse deletion or cancellation of data if your request does not comply with current regulations or if we evaluate that the request is unsafe, potentially impacting our Services, affiliate partners, or third parties.

  1. DOES METABOMB DISCLOSE INFORMATION COLLECTED FROM VISITORS?

8.1. In the course of conducting business activities, we may need to use, process, disclose, and/or transfer your personal data to third-party service providers, agents, and/or our affiliated or related companies, and/or other third parties whether within or outside Vietnam, for one or more of the aforementioned Purposes, and such disclosure shall be done in accordance with the proper procedures and regulations of current laws. These third-party service providers, agents, and/or affiliated or related companies and/or other third parties shall process your personal data on our behalf or vice versa, for one or more of the aforementioned Purposes. We endeavor to ensure that such third parties and our affiliated companies maintain the security of your personal data from unauthorized access, collection, use, disclosure, unlawful processing, or similar risks and only retain your personal data as long as necessary for the purposes stated above. Such third parties include:

  1. our parent companies, subsidiaries, affiliates, and related companies;
  2. other users of our Services for one or more of the Purposes mentioned above;
  3. contractors, agents, service providers, and other third parties that we engage to support or supplement our business operations. These parties include, but are not limited to, providers of administrative services or other services for us including but not limited to telecommunications companies, business partners, advertising and media companies, information technology companies, and data centers, payment intermediaries, ...;
  4. regulatory authorities over MetaBomb or if permitted under Section 6.2;
  5. buyers or other successors in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of all or part of MetaBomb's assets, whether ongoing or in bankruptcy, liquidation, or similar proceedings, where MetaBomb's personal data retained about our users is among the assets transferred; or to a partner in a business asset transaction in which MetaBomb or any of its affiliates or related companies is involved;
  6. third parties to whom we disclose information for one of the Purposes and those third parties in turn will collect and process your personal data for one or more Purposes.

8.2. We may share information including statistical and demographic information about users as well as information about users' use of the Services with service provider partners and other affiliated entities.

8.3. For the avoidance of doubt, in cases where privacy laws or other applicable laws allow an organization such as ours to collect, use, or disclose your personal data without your consent, the legal permission will continue to apply. In accordance with the above provisions and in compliance with current legal requirements, we may use your personal data for recognized legal grounds, including compliance with our legal obligations, to enforce our contracts with you, to achieve our legitimate interests and reasons for using that data outweigh any harm to your data protection rights or when necessary in connection with a legal request.

8.4. Third parties may block or gain unauthorized access to personal data sent to or held on the website/mobile application, technologies may function inaccurately or not as expected, or individuals may access, misuse, or improperly use information not due to our fault. However, we will implement reasonable security measures to protect your personal data as required by the regulations of privacy laws; however, absolute security cannot be guaranteed, such as in the case of unauthorized disclosure arising from malicious hacking activities or third-party attacks not due to our fault.

  1. INFORMATION ABOUT CHILDREN
    Parents or legal guardians of children are kindly requested to monitor and ensure the personal information, and take responsibility for the personal information of children provided to MetaBomb.
    When parents or legal guardians provide their own and their children's information, it means they have obtained consent for the processing of the relevant children's information and agree to be bound by this Policy on behalf of the ward.
    10. INFORMATION COLLECTED BY THIRD PARTIES
    10.1. Our website/mobile application uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files on your device, to help the website/mobile application analyze how users use our website/mobile application. Information generated by cookies about your use of the website/mobile application (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information to evaluate your use of our website/mobile application, compile reports on website/mobile application activity for website/mobile application operators, and provide other services related to website/mobile application activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process information on Google's behalf. Google will not associate your IP address with any other data held by Google.
    10.2. Our Services may use measurement tools (such as AppsFlyer, Firebase, etc.) (“Mobile Measurement Partners”, abbreviated as “MMP”). MMPs use a Software Development Kit (“SDK”) placed on your device to help us track and optimize the delivery of our Services to you. Information generated by the SDK about your use of our application (including your IP address) will be transmitted to and stored by the MMP provider. The MMP provider will use this information to evaluate your use of our Services, compile reports on app activity for developers, operate the app, and provide other services related to app activity and internet usage.
    10.3. We, and third parties, may at times provide software application downloads for you to use through the website/mobile application or via the Services. These applications may access and allow a third party to view, your identifiable information, such as your name, your user ID, your device's IP address, or other information such as the game you are playing in any given session, and any cookies previously installed or installed for you by a third-party software application or website/mobile application. Additionally, these applications may request you to provide additional information directly to third parties. Products or services from third parties provided through these applications are not owned or controlled by MetaBomb. You should read the terms and other policies published by those third parties on their website/mobile application or elsewhere.
  2. DISCLAIMER OF THIRD-PARTY SECURITY RESPONSIBILITY
    11.1. We do not guarantee the security of personal data and/or other information that you provide on third-party websites/mobile applications. We implement various security measures to maintain the security of your personal data that we store or control. Your personal data is stored behind security networks and can only be accessed by limited individuals with special access rights to our systems, and they have been required to secure that personal data. When you use or access your personal data, we ensure that there are secure servers.
    11.2. To provide you with added value, we may also select other third-party websites/applications to link to. These linked sites have their own privacy policies as well as independent and separate security measures. Even if such third party is linked to us, we do not control these linked sites or other software, each of which has its own privacy protection methods and independently collects data separate from us.
    11.3. Therefore, we are not responsible or legally liable for the content, security measures (or lack thereof), and activities of these linked websites/mobile applications or other software. These linked websites/mobile applications or other software are provided for your convenience and you are therefore responsible when accessing them. However, we are responsible for protection within the scope of our Services.
  3. WILL METABOMB TRANSFER YOUR INFORMATION ABROAD?
    Your information and/or personal data may be transferred abroad, stored, or processed outside of your country for one or more purposes. MetaBomb will only transfer your personal data abroad when it complies with the regulations of data protection laws.

 

  1. CAN YOU WITHDRAW CONSENT, REQUEST LIMITATION OF PROCESSING, OBJECT TO PROCESSING, REQUEST PERSONAL DATA, ACCESS, OR AMEND INFORMATION YOU HAVE PROVIDED TO US?

13.1. Withdrawal of Consent, Request for Limitation, Objection to Processing, Data Deletion
You may withdraw your consent, request limitation, object, or request deletion of data collected, processed, used, and/or disclosed by us by sending a written request via email to us at [email protected], and we will process these requests according to the Privacy Policy and relevant legal regulations.
However, withdrawing your consent, requesting limitation, objecting to the processing of personal data, or deleting data may mean that we cannot continue to provide services to you, and we may need to terminate the current relationship between you and/or any contract you have with us.

13.2. Request for Provision of Personal Data

13.2.1. You have the right to request that we provide your Personal Data by sending a written request via email to us at [email protected]. You also have the right to request that we provide your Personal Data to other organizations, individuals, or other organizations and individuals for you, provided that you can provide valid authorization or other documents proving the consent of the data subject as required by law.

13.2.2. Your request will only be considered valid and accepted for processing when sufficient necessary information is provided and the correct form is used as required. Upon your request, we will send you a form for you to complete.

13.2.3. Depending on the circumstances and our assessment, we may charge a reasonable fee for you to resolve and process requests for the provision of your personal data. If we charge a fee, we will notify you of the specific fee amount, and you have the right to continue to request the provision of data or cancel this request.

13.2.4. In the event that your request is valid under the provisions of data protection laws and falls within cases where we are allowed to provide data, we will notify you through appropriate communication methods about the time, place, form of providing personal data, costs (if any), method, payment terms (if any), and we will provide personal data in accordance with this notice and other procedures as required by law.
13.2.5. We reserve the right to refuse to provide your personal data under the provisions of data protection laws, in cases where those laws require and/or allow an organization to refuse to provide personal data in such cases.
13.3. Request for Access to or Amendment of Personal Data
13.3.1. If you have registered an account with us, you may access and/or amend your personal data that we hold or control through the Account Settings page on the Service. If you have not registered an account with us, you may request access and/or amendment of your personal data that we hold or control by sending a request in writing or sending an email with an attached written request to us at [email protected]
13.3.2. Depending on the circumstances and our assessment, we may charge a reasonable fee for you to resolve and process requests for the provision of your personal data.
